Fit Workforce Solutions – Terms &
Conditions

These Terms & Conditions (“Terms”) govern your participation in the fitness, wellness, and
wellbeing services (“the Programme”) provided by Fit Workforce Solutions (“the Provider”)
through your employer. By accessing or using our services, you agree to be bound by these
Terms.

1. Services Provided
1.1 Fit Workforce Solutions provides corporate fitness and wellbeing programmes delivered
entirely online via the Trainerize app and associated digital platforms.
1.2 Services may include:
● Personalised fitness and wellbeing content.
● Mobility, posture, and exercise routines.
● Educational resources relating to health and wellbeing.
1.3 Fit Workforce Solutions does not operate as a medical provider. Our services are
fitness- and education-based only.

2. Employee Responsibilities
2.1 You are responsible for completing all required screening forms (e.g. PAR-Q) truthfully and
updating us if your health status changes.
2.2 You are responsible for ensuring you are medically cleared to participate in exercise and for
consulting a healthcare professional if you have any concerns about your health.
2.3 You must provide accurate personal information to enable safe participation.
2.4 You are responsible for ensuring that your exercise environment (home, office, or
elsewhere) is safe, suitable, and free from hazards.

3. Health & Safety
3.1 Participation in the Programme carries inherent risks. You take part voluntarily and at your
own risk.
3.2 We accept no liability for injury, illness, property damage, or adverse effects sustained as a
result of participation, except where caused by our proven negligence.
3.3 You acknowledge that the Programme is delivered remotely without direct in-person
supervision.

4. Access & Use
4.1 Your access to the Programme is provided through your employer’s contract with Fit
Workforce Solutions.
4.2 You may stop using the app at any time; however, access will remain available to you for
the duration of your employer’s agreement.
4.3 You may not:
● Share, reproduce, or use any of our programmes or materials outside of your personal
use.
● Resell, redistribute, or provide access to the Programme or related content to anyone
else.

5. Insurance
5.1 Fit Workforce Solutions is insured for professional and public liability with Markel Direct.
Evidence of cover can be provided upon request.
5.2 This insurance does not extend to individual health or accident cover. It is your
responsibility to obtain personal cover if desired.

6. Intellectual Property
6.1 All Programme materials, guides, resources, and content remain the sole intellectual
property of Fit Workforce Solutions.
6.2 You are granted a limited, non-transferable licence to use the content for personal purposes
only, during the term of your employer’s agreement.
6.3 Any use outside this scope, including reproduction, distribution, or modification, is strictly
prohibited.

7. Confidentiality & Data Protection
7.1 We comply with applicable UK data protection laws, including the UK GDPR, in collecting
and processing your personal and health data.
7.2 Your information will be used solely for the administration and safe delivery of the
Programme and will not be shared with third parties except as required by law.

8. Limitation of Liability
8.1 We will not be liable for:
● Any indirect or consequential loss or damage.
● Any claim arising from circumstances outside our reasonable control.
8.2 Our total liability to you shall not exceed the value of the services provided to your
employer for your participation.

9. Termination of Access
9.1 Your access to the Programme is linked to your employer’s agreement with us. If that
agreement ends, your access will automatically terminate.
9.2 We reserve the right to suspend or terminate your access immediately if you breach these
Terms.

10. Governing Law
10.1 These Terms are governed by and construed in accordance with the laws of England and
Wales.
10.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and
Wales.
